Syllabus

Obiettivi Formativi

In the end of the course the students should know the legal framework and the protection offered to different categories of migrants, the reform of the CEAS System and the protection for the vulnerable groups. In overall, 20 themes covered during the course.
In the overview of the module on Kiro students can find detailed learning outcomes.
Different level of protection and the problems related to it. The level of protection should be illustrated by case law discussed in class and uploaded on Kiro.
For example students should know (some examples of the learning outcomes (LO):
1) Protection offered to stateless people, the lacunas, regional instruments discussed in class and case law
2) Protection of IDPs, duraple solutions and the current strategy to help them
3) Refugees, Geneva Convention, case law
4) The Reform of the CEAS systeme and the relevant case law.

Prerequisiti

Having had at least one course in law would be an asset. The course is law in context but being familiar with some methology how to study law would be beneficial.

Metodi didattici

There will be alternating lessons and student presentations. The programme of lessons proposed by the teacher, with the possibility of choice regarding certain themes. The programme of student presentations will be chosen together with the students.
The teaching will be based on the analysis of legal texts of European Union law: treaties, legislative and implementing instruments (directives, regulations, decisions, international agreements), case law of the Court of Justice of the European Union.
Relevant texts will be accessible in advance on the Kiro platform and should be read before the presentation for students' presentations.
Until the risk of Covid-19 counting disappears, lessons and presentations will be streamed on the Zoom platform.

Verifica Apprendimento

The module is designed as a Students Active Learning Module. Students are expected to read for each week relevant material and prepare 5 very short, one page long task that considers a specific theme of the course.
They also need to do a group presentation that counts for 30% of the final mark.
Non frequentanti need to fulfil these requisits in order to take up the exam.

Testi

There is no one text covering all the themes. The subject is very dynamic and ofen discusses the current issues such as the war on Ukraine and the Temporary Protection Directive. Protection of IDPs in Palestine. The current changes in the law.

Students:

Frequentanti e non frequentanti need to visit Kiro where under each argument they can find reading, policy documents, conventions, legislation, case law and slides cuvering each lecture.

Contenuti

The programme covers International, European and Domestic dimension of migration, all influenced by the human rights’ perspective. From the international angle, the course will analyse the safety and security of refugees, refugee rights through the enhanced supervision, non-refoulement obligations in public international law and the specific International Laws appropriate for different categories of migrants (ex, ILO instruments for labour migrants). Some other issues such as responsibility and protection of Asylum Seekers, illegal migration: discrimination and protection will be discussed in light of International and European Frameworks. Further, we will consider the EU migration, the position of third country nationals, family re-unification and discrimination. In the second part of the course we will deal with human trafficking, child migration the situation of unaccompanied children and their protection, rights of the child, coercive instruments towards migrants, detention and the human rights implications of the latter

The module is designed for students attending the class. They discuss legislation, case law, the reforms and prepare for each class.
It is difficult to satisfy all final requirements without attending the module. Nonetheless, it is not prohibited to take the exam as non frequentante after having completed the fractions of the final mark.
