Course Objectives
The course aims to provide the essential elements of knowledge and understanding of labour law.
Course Prerequisites
Essential knowledge of both private and public law is required
Teaching Methods
Frontal and seminar type lessons.
Assessment Methods
The examination will take place in oral form and will consist of an interview to ascertain the understanding of legal problems, and their solutions, relating to the subjects dealt with in the course.

For the labour law part: - M. MAGNANI, Diritto sindacale, Torino, Giappichelli, 2024. For the employment law part: - M. MAGNANI, Diritto del lavoro, Torino, Giappichelli, currently being updated. For the part of the individual work relationship, the text will be indicated in the lesson and on the teaching site at the beginning of the lessons. Students will have to know, in addition to the constitutional and codicistic norms on labour matters, the main special laws. For this purpose they will be able to make use of an updated Labour Code: these are collections of laws relating to the subject, published by the main legal publishing houses.
Contents
Particular attention will be paid to the illustration of the sources of discipline and regulatory techniques typical of the subject. The structure of the sources of discipline of the relationships covered by labour law is in fact complex: next to the law and the individual contract itself, there is the collective contract, a peculiar legal figure, at once contract and regulatory act. It is for this reason that a large part of the course will be dedicated to the so-called trade union law, which represents, to a large extent, the law of the sources of discipline of employment relations.
The course will be divided into two parts. The first will focus on the fundamental themes of trade union law (trade union subjects and forms of collective representation of workers, collective agreements, collective conflict); the second will focus on the discipline of individual labour relations.
In particular, the following topics will be dealt with:
- The historical evolution of labour law: hints at labour law of the origins and the corporate period. The structure of the sources of labour law. The constitutional framework of reference.
- The trade union organization and its legal regime. The forms of workers' representation at company level, trade union rights and the repression of anti-union conduct in the workers' statute. The collective agreement and its legal regime in the private sector and the public sector. The evolution of the structure and content of collective bargaining. The strike, with particular regard to essential public services. The lock-out.
- Contract and employment relations. The notion of subordination as a central case in labour law. The distinction between subordinate, autonomous and parasubordinate employment relationships. The typological articulation of employment relationships. Content, events and termination of the employment relationship (in particular: obligations of the parties and powers of the employer, tasks and qualifications of the employee, suspension of the employment relationship, individual dismissals, collective redundancies, transfer of business, guarantees of workers' rights).
