Syllabus

Course Objectives

At the end of the course, the student is required to have in-depth knowledge of the structure of the civil process and of the regulatory provisions governing its functioning. The mastery of the fundamental principles that inform the procedural order is necessary and fundamental, and therefore will constitute a significant part of the learning process. Furthermore, the student will be able to understand the application of the procedural rules to concrete cases, also through the reading and explanation of some of the most important jurisprudential rulings. They will be able to analyse and evaluate the interpretative jurisprudential orientations with a basic critical approach. They will be able to present the institutions of the civil process of cognition in an argumentative way, highlighting their functions and functioning mechanisms.

Constitutional law, private law institutions I, private law institutions II are preparatory to Private Law Procedure

Teaching Methods

The course is based on lectures supplemented by a cycle of seminars. The discussion of the topics will be aimed at the achievement of the above-mentioned educational objectives. Seminars will focus on the in-depth study of jurisprudential cases on issues of particular relevance and interest.

Assessment Methods

Learning is verified through an oral exam aimed at ascertaining the achievement of the educational objectives. The subject of the examination is the content of the reference textbooks and, for students attending the lectures, the contents of lectures and didactic seminars. The assessment will take into account the ability to expose appropriately from an argumentative point of view.

Textbooks for exam preparation. As the main textbook, choose one between the following books: - P. Biavati, Arguments of civil procedural law, Bologna, Bononia University Press (most recent edition available) chapters I, II, III, IV. - C. Mandrioli, A. Carratta, Course of civil procedural law, Turin, Giappichelli, (most recent edition available), vol. I and II. Recommended supplementary readings: 1. On the judicial system, constitutional aspects and organization of civil justice: P. Biavati - D. Cavallini, - N. Zanon, Structures of civil and criminal justice in Italy, Bologna, Il Mulino, 2016, only part I, §§ I, II and III, and the second part, §§ VI, VII, VIII, IX. Further supplementary readings may be indicated during the course. It is essential to consult an up-to-date edition of the code of civil procedure, updated to the most recent reforms. It is also recommended to consult: 1) Carpi Taruffo, Short Commentary on the Code of Civil Procedure, Padua, Cedam, latest edition available; 2) 2) Gamba (a cura di), I decreti correttivi della riforma Cartabia. Le principali novità in materia di giustizia civile, Pisa, Pacini Editore, 2025.

Contents

The course focuses on the ordinary civil process of cognition (in particular: articles 1-162 c.p.c., libro I, articles 163-408, libro II, c.p.c. and other necessary regulatory references, contained in the civil code or in special laws). Knowledge of the general principles of Private procedural law as well as of the main legal and organizational aspects of civil justice is essential. During the lessons, some general aspects of the process will also be addressed as a context for constructing arguments.
