Syllabus

Course Objectives

The course will allow the student to frame the cultural and ideological context of the change from common law to codes law in Italy. The course will provide the student with critical and analytical tools to contextualise and understand the choices adopted by the italian legislator, with the national codes first and then with codes from the Fascist era.

Course Prerequisites

Law students must have passed the exam of History of Italian Law. Generally speaking, an attitude towards law reasoning is expected from the student, together with a basic knowledge of law.

Teaching Methods

The course is based on taught classes with PowerPoint presentations of sources, documents, materials and images. Students attending the degree course of Law will be involved in individual exercises during lessons. At the beginning of the course, a topic of research will be assigned and the student will need to find (throught the university's OPAC) some sources, read them and carry out a critical analysis which, at the end of the course, will be the subject of an oral and short written report. Both concur to the final score. Therefore. the course includes 1 credit as laboratory.

Assessment Methods

For students attending the degree course law, there are three parts of the exam: 1)an oral presentation at the end of the course, of the assigned topic of research through photocopies, Powerpoint or other tools; 2) a preliminary interview with the Professor concerning notes taken during lesson; 3) writing of a short written report in chapters, paragraphs, text and notes, concerning what has been discussed orally.
There is no specific deadline for the delivery of the report. The result of the three tests will allow the Professor to evaluate the student with a final mark, as average of the marks obtained in the three tests.
For students of Global History of Civilizations an Territories, the duration of the course is 36 hours without exercises..

Texts

Students attending the degree course of Law will need to take an exam in three parts, as already mentioned.
Non-attending students will need to go through the following books:
M. Lucchesi, Diritto, pedagogia, femminismo. Valeria Benetti (1908-1914) in Studi di cultura giuridica, 3, ed. Satura, Napoli 2023 pp. XI-262
Foot notes are intended to be studied.

For students attending the degree course of Global History of Civilizations and Territories, the texts are as follows :
M. Lucchesi, Diritto, pedagogia, femminismo. Valeria Benetti (1908-1914) in Studi di cultura giuridica, 3, ed. Satura Napoli 2023, pp. XI- 176. Foot notes are intended to be studied. Additionally you need to bring the notes you took during the lessons.

For students non attending :
M. Lucchesi, Diritto, pedagogia, femminismo. Valeria Benetti (1908-1914) in Studi di storia giuridica,3, ed. Satura Napoli 2023, pp. XI-262. Foot are intended to be studied.

Contents

The course reviews the historical, cultural and social background of the development of pre-unitary, unitary and current codes, by analyzing the choices of the Italian legislator, specifically with regards to civil law. The topic of history of family law in Italy and the role of women in the past regime, pre-unitary codes and during Fascism will also be reviewed.
