Course Objectives

The course follows up to the classes of Principles of Private Law (Part 1) included in the the first year, completing the description of the fundamental principles of the Italian legal order with regard to the relations regulated by Private Law (with the exclusion of the part concerning Business Law).

Course Prerequisites

Prerequisites: Principles of Private Law (Part 1). A good knowledge of the topics included in the programme of the course of “Principles of Private Law (Part 1)” is needed and, in particular, of the principles concerning the juridical relation deriving from an obligation and the general features of the contract.

Teaching Methods

The course is organised in frontal lessons, where the institutes of Private Law included in the programme are explained with reference both to theoretical principles and through their applications to practical circumstances.

Assessment Methods

The exam is divided into two parts. The first part, consists of a written exam, composed of a section of closed-ended questions, an open-ended question and a practical case to be solved. This part concerns three of the four modules into which the teaching is divided. The second part consists of an oral question and concerns the remaining module. The second part can only be accessed if the first is sufficient.

SCHLESINGER, Manuale di diritto privato, last edition available, in the following parts: specific types of contracts, obligations deriving from unilateral acts, from the law or from an act against the law; family relationships; succession pursuant to death; acts of liberality; property listing.
As an alternative, other manuals addressed to university students and suggested for the study of Principles of Private Law (Part 1) can be used.
The knowledge of the respective legislative texts (Civil Code and specific provisions of law) is fundamental. The most relevant and most recent normative updates will be nevertheless highlighted during the lessons.

Inclusive measures in favour of specific categories of students.
For the students with a certification to be in one of the conditions determined by the guidelines of the University (worker; caretaker of family members; civil invalidity; differently abled or with Specific Learning Disorders; parent; athlete; subject to measures of criminal detention; hospitalized) and who cannot attend the educational activities in person, the professor will guarantee up to two office hours each week, also remotely, with flexibility around the timeframe according to the needs of the
student.
The educational activities will, moreover, be supported by tutoring or by supplementary teaching hours, also after 6 p.m., from Monday to Friday, with the aim of promoting learning also for the students belonging to the above-cited categories.
