Syllabus

Course Objectives

The course aims to provide necessary tools to critically understand potential and limitations of applying artificial intelligence to public administration. Through the analysis and discussion of real-world cases, as well as the preparation of written reports or presentations in class, the course also seeks to introduce students to legal cases analysis in order to develop their argumentative skills. These activities are part of a training path designed to equip each student with the skills needed to interpret and apply the law—skills that are essential in the professional world

Course Prerequisites

Good knowledge of public law fundamentals is required as well as of legal sources system.

Teaching Methods

Lectures, with projections of powerpoint presentations, case studies, classroom exercises and in-depth seminars.

Assessment Methods

Oral exam aimed at verifying the achievement of course learning objectives. Final grade is expressed on a scale of thirty, with honors (“lode”) awarded when applicable. The exam will cover the content of the reference texts and, for attending students only, lectures content.

Texts

The exam syllabus requires the study of the following volumes: G. Avanzini, Decisioni amministrative e algoritmi informatici. Predeterminazione, analisi predittiva e nuove forme di intelligibilità, Editoriale Scientifica, Napoli, 2019. R. Cavallo Perin, G. Galetta, Il diritto dell’amministrazione pubblica digitale, Giappichelli, Torino, 2025. Study of the latter volume is limited to the following chapters: Introduction; Chapters 1, 3, 4, 5, 6, 7, 8, 9, 10, 11, and 15. Chapters 2, 12, 13, 14, 16, 17, and 18 are excluded. For attending students, the syllabus may be specified during lectures and supplemented with materials and court decisions distributed during the course.

Contents

First part of the course is intended to provide students with artificial intelligence notion and other institutes attributable to weak and strong digitization. The general principles that are establishing themselves in our legal system and in the European one will then be analyzed in order to better guarantee the fundamental rights of citizens in the relationship with digital administration. Second part of the course deals with impact thatIT transformation had on administrative organization (AGID, Agenzia Nazionale per la Cybersicurezza) and on public services, with particular reference to digital platforms use. Particular in-depth analysis will be dedicated to the total or partial automation of administrative procedures and to its legal problems. Last part of the course will analyze digital public procurement regulation, smart city, smart mobility and Uber, landscape digital government, ehealth.
