Obiettivi Formativi
The course aims to give students with a general understanding of the main elements of public law, with a particular attention to PA communication and emergency communication. The objective of the course is to offer an overview of the Italian form of Government drafted by the Constitution, in order to understand how public institutions operate, how their action can impact on people’s lives, what are the constitutional limits, and, finally, how risk and emergency communication tools are communicated by public authorities and, above all, the National Civil Protection Service under the coordination of the National Department of Civil Protection within the Presidency of the Council of Ministers. By the end of the course, students will have acquired theoretical skills not only in Public Law, but also in Private Law (with special reference to principles and rules of the General Data Protection Regulation) as well as theoretical-practical skills in risk communication, with the aim of being able to develop appropriate tools and modes of communication in an emergency context that involves the action of public authorities.
Prerequisiti
There are no mandatory prerequisites to access the course.
Metodi didattici
The course is based on lesson in which the professor will explain and clarify the main topics, while also encouraging the active participation of students in order to develop their critical thinking and provide a methodological guidance for study. References will be made to current issues involving the institutions addressed from time to time. This teaching approach will also allow ongoing verification of the specific vocabulary acquisition and mastery of legal language. Verifica Apprendimento
The exam is written. To reach the final grade, the following criteria will be considered: knowledge of the subject and completeness in writing; the quality and correctness of the constitutional and regulatory references; the clarity of the answer and correct use of legal language; the quality and correctness of connections/comparisons with other parts/institutions of public law. In the event of technical issues, there will be an oral exam. In case of particular needs, students may be called in for an oral exam.

Contenuti
Public Law investigates the main institutions that characterize the Italian form of Government – particularly how power is distributed among public bodies - starting from the 1948 Constitution and its principles. The course begins with a theoretical introduction on the birth of the Constitution, also through the analysis of the work of the Constituent Assembly. The previous Albertine Statute will be examined, highlighting elements of continuity and difference between the two constitutional charters. The course will then explore the sources of law and the parliamentary form of government within the Italian constitutional system, focusing on the Government and public administrations, fundamental rights and freedoms and the judicial review of legislation. It then addresses the communication of PAs, the communication of risk and emergency, about the National Civil Protection Service in Italy. Particular attention is paid to fundamental rights and to the importance of preventive risk communication, through the sharing of scientifically correct information between public authorities and citizens to learn procedures, self-protection behaviours and good practices to be adopted during the onset of risk. In the context of emergency communication, data protection also deserves special attention, considering the many relevant issues (such as those related to the geolocation of individuals) that may arise in connection with the processing and free movement of personal data. In the light of this, a final part of the course will then be devoted to the study of data protection, with a focus on principles and rules (national and supranational) - particularly those of the GDPR (General Data Protection Regulation) – in the context of both public and private law.
